JSC "Zhytomyrski Lasoschi" is appealing against double collection by the Antimonopoly Committee of Ukraine.

Despite the voluntary execution of the court decision in case No. 910/18430/23 — on the payment of a fine of 2,030,125 hryvnias, Joint-Stock Company "Zhytomyrski Lasoshci" again became a defendant in the lawsuit of the Antimonopoly Committee of Ukraine (AMCU) — this time on the collection of a penalty.
The prerequisite was case No. 126-26.13/75-20, which was considered by the AMCU on the grounds of abuse of a monopoly (dominant) position in the national market for the primary sale of corn starch molasses and glucose syrups. This case involved LLC "Interstarch Ukraine", PJSC "Dniprovsky Starch-Troika Combine" and PJSC "Intercorn Corn Processing Industry".
On October 6 of this year, JSC “Zhytomyrski Lasoschi ” also paid a penalty of 2,014,477.50 hryvnias and a court fee of 24,173.73.
According to Albina Naumova, a lawyer for “Zhytomyrski Lasoschi ”, the Committee’s decision is unfounded: “Both amounts of over two million hryvnias determined by the AMCU for failure to provide information regarding other legal entities are absurd. The subtlety lies in the fact that the fine of 2,030,125 hryvnias was paid voluntarily — even before the full text of the appellate court’s decision was published. Therefore, the penalty is groundless and actually means double recovery.”
“An unfair situation has developed. Under martial law, the company continues to operate stably, provides jobs for residents of the Zhytomyr region, pays taxes, and helps the Armed Forces of Ukraine. We voluntarily complied with the court decision, and the penalty was a surprise,” adds the company’s lawyer, Olga Chetvertukha.
The Joint Stock Company is currently preparing a cassation appeal to the Supreme Court to return UAH 2,014,477.50 in penalties in order to use these funds for production development.
